Use of This Web Site

Access to and use of this website is provided subject to the Terms and Conditions of Use (this document) which you should read carefully. By accessing this website you hereby accept same. While astromi.ch has taken all reasonable steps to ensure the accuracy and completeness of the information on the pages of this site it can accept no legal liability in respect of any inaccuracy or incompleteness in such information.

 Scope of Application

Our General Terms and Conditions shall exclusively apply. We do not acknowledge any terms that contradict or differ from our Terms and Conditions, unless we have expressly agreed to them in writing.

Conclusion of the Contract

1. The purchase contract is concluded by us accepting your order by our order confirmation or when the package has been handed over to the swiss postal service or any other means of transportation that was prior agreed to.

2. We reserve the right to carry out a credit assessment even after conclusion of the contract and to withdraw from the contract in case of a negative result. We also reserve the right to withdraw from the contract in the event that the goods are not available for a period of at least four weeks or if there are data errors which prevent us from carrying out your order.

Shipping

Shipping costs

Shipping costs depend on the number and weight of the packages and the country of the shipping address. A table on our pages lists the weight and destination country related shipping costs. If you add items to your shopping cart and enter your address, you will be shown the exact shipping costs before you conclude your order.
Since shipping costs are particularly high for certain products and destination countries, we reserve the right to charge you the actual shipping costs instead of the specified flat rates. In such rare cases, however, we will contact you before shipping the items.

Custom duties

For deliveries of goods outside of Switzerland, import duties (customs duties) may apply. These additional fees are the sole responsibility of the purchasing party.

Import process

The import process is the sole responsibility of the purchasing party. We will provide all necessary information in regards to the content and the value of the package via the standard form offered by the swiss postal service. Any additional documentation that may be required by customs has to be provided by the receiving party.

Failed delivery

If the package can not be delivered it will usually be returned to us. We will not charge any fees for re-shipping the package to either the same or a different address, except for the actual shipping costs. If the delivery failed because of an error made by us, the customer does not have to pay anything for a second delivery.

You can use the following methods of payment:

  • Advance payment by electronic funds transfer

Retention of Title

The delivered goods remain the property of astromi.ch until they have been paid in full.

Right of withdrawal

Information concerning the exercise of the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (Martin Ingold, Maneggpromenade 155, 8041 Zurich, Switzerland, E-Mail info@astromi.ch) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, excluding any expenses that were already paid by us (shipping, credit card transaction fees etc.), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We reserve the right to withhold reimbursement until we have received the goods back.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

We reserve the right to charge a 10% restocking fee.

Exclusion of the Right of Revocation:

There is no right of revocation for distance contracts for the supply of goods made to the customer’s specifications or clearly personalized or which, by reason of their nature, cannot be returned. Furthermore, there is no right of revocation for contracts for the supply of audio of video recordings or computer software, to the extent that the delivered data media were unsealed by the consumer.

Complaints/Damages Sustained in Transit

If the packaging has externally visible signs of damage upon delivery, then delivery should be refused and the shipper notified accordingly (please note the deliverer’s name) or the contents should be examined for completeness in the deliverer’s presence and the goods checked to ensure that they are in good condition wherever possible. In any case, we ask that you document any damages in a damage report.
If you do not realize that the goods are damaged until the package is opened, please contact us immediately so that we can report the damage to the transport company (E-mail: info@astromi.ch) We will require your assistance to settle and adjust claims for damage sustained in transit. For this reason, we ask that you keep the packaging unchanged as evidence and refrain from using the damaged goods. You can additionally help us by taking pictures to document the damages.
In the event of a misdelivery, we ask that you contact us before you return the goods to us. We will pay the return shipping costs if your complaint is justified.

Warranty

The warranty period for consumers is one year for new items. In the case of companies, warranty claims become time-barred within one year for new items; there is no warranty for used items. This does not apply to claims for damages caused by injuries to life, limb or health due to a defect attributable to astromi.ch or due to gross negligence or wilful misconduct on the part of the seller. Liability for damage caused to legal property of the purchaser by the delivered item, such as damage to other items, is excluded completely. The statutory warranty provisions apply accordingly.

Returning Goods

Before returning goods, please get in contact with us. Shipping costs are usually not that cheap, and if a return is declared wrongly, high custom fees may incur. To prevent this, Astromi.ch only accepts returns upon prior agreement and refuses the acceptance of packages, if we have not given consent first.

Partner Program

The partner program is based on mutual trust. The partner is not allowed to sue for reimbursement of advertising costs incurred in connection with the partner program.

Severability Clause

If individual provisions of our Terms and Conditions are or become invalid in whole or in part, the validity of the contract and the other items shall remain unaffected by this.
